U.S. Immigration and Customs Enforcement arrested a citizen of the United Kingdom who misrepresented himself upon entry when he failed to disclose his criminal record in his home country.
ICE Buffalo officers apprehended Orlando Duncan Da Silva Bain during a targeted enforcement operation on May 7 in Niagara Falls, New York.
Da Silva Bain, 19, was recently admitted to the United States as a non-immigrant in Orlando, Florida.
By failing to acknowledge his significant criminal record in the UK on his Electronic System for Travel Authorisation application, he violated the terms of admission under the visa waiver program and is thereby amenable to removal from the U.S.
After Da Silva Bain’s admittance, officials discovered he had been convicted of taking a child to keep the child from a person having lawful control; engaging in penetrative sexual activity with a minor; causing the sexual exploitation of a child aged 13 to 17; possessing indecent photograph/pseudo-photograph of a child; cause a child aged 13 to 15 to watch at an image of sexual activity; and postal service-sending obscene article.
Da Silva Bain is in ICE custody at the Buffalo Federal Detention Facility pending his removal from the U.S.
